At the very least you made me more trustful of Jast with this article, I won't say I endorse this until I see the final result, but if it is as you say then I won't have anything to complain and I'd actually prefer it if it keeps the whole thing in low profile instead.

So I guess now we play the waiting game. Good article~

Not in Califorina.  As far as I know, the California Penal Code requires said porn to involve real minors to be illegal.  Because of the way it's worded, it does not apply to hentai or other types of cartoon porn.  Of course, that clashes with federal law, though, but so do several states' laws legalizing pot.  Admittedly, it is a little old for a source, but that's the most up to date source I could find.

 

On the original topic, I'm not really interested in anything related to School Days; I've heard subpar things about it.

 

obscenity law is meant to be vague so it can be interpreted by each district independently it matters not where in the usa you live if someone wants to prosecute you for content they deem obscene the law is applicable, its then up to the court to decide if it falls under the obscenity laws legal definition.

And all this is why I`m a huge all-ages fan. I wish all the VNs with stories would be released as all-ages right from the get-go so there would never be any censoring needed. If people want porn they should buy porn, and if they don`t want porn they shouldn`t be forced between paying for and supporting porn and getting good stories they want to read.

 

There are certain games with plots that just do not work as all-ages.

 

Saya no Uta without the adult content would severely reduce the impact of the game, as well as change the way characters see various characters. Not every game with sex scenes has them just tagged on to sell games.

Sex =/= porn.

This. There's plenty of sex even in all-ages games, it just doesn't have to happen on screen with all the moaning and fluid explosions.

But I also agree that just slicing stuff out with nothing to replace it is not the solution. Sadly the companies tend to be very lazy about this. In most all-ages ports they just write up a clumsy bridge scene to skip over the parts where the porn was and in a lot of them they don't even bother to voice those scenes because they were so hastily prepared. In a perfect world the all-ages version would have all-new content and more story depth to make up for the fact that it is missing the porn. Alas, for now we must simply settle for the neutering approach.

A JAST staff member (likely Nicholas Graham) added the following clarification regarding JAST's decision to censor the official release Shiny Days, yet leave Song of Saya and Littlewitch Romanesque unedited:

... Canadian [JAST] staff are scare[d] since the incident of the Canadian eroge staff member [getting detained and charged for importing an obscene eroge]. Their involvement in the distribution of similar material could result in problems for them, and it'd be immoral for us to put our staff at risk for customer or company gain.
 
On the US State side, our company is at risk under California Penal Code 186.2.3 as defined by 311.2, with the crux of a hypothetical court case being the literary and artistic value of the game based on not our standards but "contemporary community standards." LWR and Song of Saya have themes, gameplay and stories that are easier to defend than those within Shiny Days when taken as a whole. Those are the facts of the situation...

Well if we know one thing, this is one VN which will never see the light of day on the Australian market.

 

(Come to think of it, does Australia get any VNs? Other then Steins;Gate, which got a ridiculous MA15+ - meaning no one under 18 can buy it in certain Australian territories, due to stupid laws that had to be put in place just so adults could be treated like adults - for 'Strong themes, violence and references to sexual violence'. Oh, and Yume Miru Kusuri, which is straight-up banned.)

After reading sanahtlig article on this specific issue I will most likely end up buying it. Normally I would sit around and wait for it to be released so I can pick it up for free but I want to get more into the VN world and decided I would purchase my VN's if they are able to be bought (in ENG). Thanks for the article sanahtlig I'll continue to look out for your stuff was pretty interesting.

After reading sanahtlig article on this specific issue I will most likely end up buying it. Normally I would sit around and wait for it to be released so I can pick it up for free but I want to get more into the VN world and decided I would purchase my VN's if they are able to be bought (in ENG). Thanks for the article sanahtlig I'll continue to look out for your stuff was pretty interesting.

If I've inspired one more VN fan to give back to a hobby they're passionate about, then I consider that a victory, regardless of the particular game or the circumstances surrounding it.

While I haven't played LWR I can kind of assume they can come up with some excuse like the girls not being as young as they look and there actually being a deep story arc surrounding the romance between the main character and them.

 

With Kokoro it's like

'Yeah so this guy rapes his girlfriend's kid sister'

'Why? Does it have some deep significance to the plot'

'Eh nah he just does it for funsies and the game plays it up as comedy'

I had an amusing exchange with a rabid opponent of censorship in JAST's official thread.  

 

I honestly don't know why you engaged. His incessant whining was just irritating and he sounded like yet another entitled, spoilt, brat trawling the internet, and while there are many such specimens around none of them are worth listening to. Just ignore them and let them cry by themselves.

For those curious about other entries in the series, I've posted a review of Japanese-language title Cross Days, an alternate retelling of School Days from the perspective of Yuuki Ashikaga.

Also, JAST has updated the release date for Shiny Days.  It's now slated for an August 25, 2015 release.

You know, now that I think about it, it's pretty amusing that JAST is making use of the same site that will probably be used to pirate the game itself.

Well... Considering there are J-list ads on nyaa, you could say they're pretty much funding it themselves anyway...
