man in Quebec city given 60 days jail time for watching lolicon hentai

http://www.animenewsnetwork.com/news/2014-09-10/quebec-man-sentenced-to-60-days-for-watching-hentai-anime/.78594

from the above article.

"The prosecution said that investigators recovered 210 "hentai" files from a hard drive, as well as 501 web addresses from Tremblay's browser history. Crown prosecutor Nathalie Leroux argued, "Whether it's a cartoon image or a photograph, any representation of underage people's genitals is illegal under the Criminal Code." "

my opinion on this

the man got 60 days in prison and 10 years on the sex offender list for some freaking hentai!. thats ludicrous. i may not watch lolicon hentai but i do enjoy alot of the darker hentai that come out and it sickens me to see someone prosecuted for watching an animated show . they aren't real people, no humans were harmed in its creation, no one was exploited and taken advantage of, this is just retarded.

It's ridiculous but it's in the penal code that any sexual representation of underaged people is illegal in Canada so the man should have known better this could happen.

France also has this, you can get finned/go to jail for watching lolicon anime in France too.

What's funny is that the article says they were representations of underaged people, implying they were probably not even lolis, just some highschoolers, which is basically 80% of the hentai industry. So apparently to Canada hentai = child pornography now.

described as "Japanese child-porn cartoons known as hentai."

Yep. Though what I find ridiculous is the fact he was registered as a sex offender, that makes no sense at all in my head since he didn't assault or harm anybody.

I guess now he'll be stuck with the western porn where adults act and dress like highschoolers to feed the exact same kind of fantasies you're trying to feed with 2D, except the latter which involves no real human beings is illegal. Oh society.

Unfortunately, from what I see, it seems that lack of understanding led to this judgment. Old, white boomers in America thought that SOPA was a good decision the moment they heard it, then opposed it with a notable majority once the Internet opened their eyes to the fact it actually would have been a terrible decision. The authorities in Canada probably never knew of the existence of such an isolated fandom prior to this, so it's understandable that they would immediately dismiss any possibility that this could be acceptable. This decision hinges upon the fact that those in charge comprehend the situation; otherwise, Japanese politicians, who are (regrettably, I'm sure) subject to the hobbies of their nation's youth, most likely wouldn't have expressly mentioned the exception of hentai when they outlawed possession of child pornography.

So if they didn't charge him, they'd look like fools if someone else caught on to this.

Imagine the scandal in the news that would get out if some cracker got his hand on a guy watching porn in the Pentagon and released it to the press.

"Senate caught watching kiddy cartoon porn. Fox News commentator calls it, "An embarrassment to our nation unlike anything since Clinton."

what i don't get is that most hentai have something stating that all people in this are not real and are 18 years of age ( something like that) thats why VNs always have 18yo students so how can they charge him.

thats not completely true most hentai anime, and art and manga don't come with this type of warning to cover your ass in a court case, some does thats true and some have splash screens with the legal info in Japanese that most subbers and licensed retailers don't bother to translate since this isn't a common problem.  also it isn't really very valid of a coverage legally any way at least not here in the USA, since they can always just use the obscenity law and deem it as obscene material with no redeeming social value and build a case on breaking obscenity laws and importing or own obscene material.

I also find it ridiculous that you're prossecuted just for posessing such material (I'm assuming nonof the material was actual real life CP) but what can you do? It's in the law so you have to suck it up, no one's going to support you if you try to make it legal, they'd just see you as a criminal so these laws are unlikely to change.

I agree. Now he's labeled a child predator. His life will never be the same.
